Terms of Service

These Terms of Service ("Terms") govern your use of the SerpHubAPI website at https://serphubapi.com, the API at https://api.serphubapi.com, the console, the MCP server and related services (together, the "Service"). The Service is operated by SerpHubAPI, an independently operated service run by an individual developer ("SerpHubAPI", "we", "us").

By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms for it, and "you" means that organization.

1. Accounts

  • You sign in with your email address and a one-time verification code. You must provide an email address you control and keep it up to date.
  • You must be at least 18 years old, or the age of legal majority where you live.
  • You are responsible for all activity under your account and API keys. Keep your keys secret. If a key is exposed, disable it in the console and create a new one.
  • One person or organization may not create multiple accounts to obtain additional free credits.

2. The Service

  • The Service returns publicly available search results and the content of publicly accessible web pages through an API.
  • We may add, change or remove engines, result types and features. We will announce material changes to the API in the documentation changelog in advance where reasonably possible.
  • The Service is provided on an "as is" and "as available" basis. We do not guarantee any particular availability, response time, completeness or accuracy of results. Results reflect third-party sources that we do not control.

3. Credits, payments and refunds

  • The Service is paid for with prepaid credits. Prices per action and top-up tiers are published on our pricing and billing pages and may change; changes do not affect credits you already hold.
  • Payments are processed by Creem, our merchant of record, in US dollars. Creem is the seller of record for your purchase and handles applicable taxes and invoicing. By paying, you also agree to Creem's terms. We do not store your full card details.
  • Purchased credits do not expire. Free gift credits expire as stated when granted (currently 30 days) and have no cash value.
  • Calls that fail, searches that return no results, and cache hits are not charged, as described in our billing documentation. The amount charged for each call is shown in its response.
  • Credits are non-transferable and not redeemable for cash. Unused purchased credits may be refunded at our discretion, or where required by law; contact support@serphubapi.com. Credits obtained through fraud, chargebacks or abuse may be removed.
  • Applicable taxes on your purchase are collected and remitted by Creem as merchant of record.

4. Acceptable use

You must use the Service in compliance with all applicable laws and our Compliance and acceptable use page. In particular, you must not use the Service to:

  • infringe intellectual property or other rights of any person;
  • engage in fraud, phishing, spam, impersonation or any other illegal activity;
  • collect or process personal data unlawfully;
  • interfere with, overload or attempt unauthorized access to the Service or any other system;
  • resell, sublicense or share access to your API keys, except as part of your own product where your end users do not receive your keys;
  • circumvent rate limits, credit limits, free-credit rules or other technical restrictions.

5. Your responsibility for data

You are solely responsible for how you use the search results and content obtained through the Service, including compliance with the laws that apply to you and the rights of content owners. We do not assume legal responsibility on your behalf for your use of that data, and we do not provide legal advice.

6. Suspension and termination

  • You may stop using the Service and request account closure at any time by emailing support@serphubapi.com.
  • We may suspend or terminate your access, with or without notice, if you breach these Terms, if your use creates legal or security risk, or if required by law. Where we terminate without cause, we will refund unused purchased credits.
  • On termination, your right to use the Service ends. Sections 3 (as to amounts owed), 5, 7, 8, 9 and 10 survive.

7. Intellectual property

We own the Service, including our software, documentation and brand. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You keep any rights you have in your own data. Feedback you give us may be used without obligation to you.

8. Disclaimers and limitation of liability

  • To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
  • To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill.
  • Our total liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

9. Indemnity

You will defend and indemnify us against claims, damages and costs (including reasonable legal fees) arising from your use of the Service in breach of these Terms or applicable law, or from your use of data obtained through the Service.

10. General

  • Governing law: These Terms are governed by the laws of China, and disputes are subject to the exclusive jurisdiction of its courts, unless mandatory law where you live provides otherwise.
  • Changes: We may update these Terms. We will post the new version with an updated date and, for material changes, notify you by email at least 14 days before they take effect. Continued use after that means you accept the changes.
  • Entire agreement: These Terms, together with our Privacy Policy and any written agreement you sign with us, are the entire agreement between you and us about the Service.
  • Language: If these Terms are provided in multiple languages and they conflict, the English version prevails.
